Delivery of site content (text and multimedia) to ITLover is the customer’s responsibility. Materials must be submitted before work begins.
The contract does not hold ITLover responsible for the copyright of the multimedia/graphic elements provided by the customer. Any artwork, images, or text created by us at the client’s request shall remain the property of us and/or its suppliers unless otherwise agreed.
Although ITLover will do its best to achieve the delivery of all services within the pre-agreed time, sometimes it may be necessary to extend or adjust the time in case of any unavoidable and unforeseeable situations, such as deployment issues, changes, delivery/disruption of third-party support services, development delays, unavailability of resources due to emergency situations, communication interruptions, and the like.
ITLover will provide the Client with the opportunity to review the website design and content after its completion. ITLover must wait a period of 7 days to receive any feedback from the customer on the shared work/results. In the event that the Customer does not respond within this period, such material shall be deemed automatically accepted and approved by the Customer.
The customer retains the copyright to the data, files, graphic logos provided by him and grants ITLover the right to publish and use said material for the production of the order. The customer must obtain permission for media files that are copyrighted by third parties. The customer is also responsible for the right granted to ITLover to use said resources for the production of the site. ITLover shall not be responsible for any copyright claims of the supplied materials resulting from the Customer’s negligence or failure to obtain proper copyright permissions. A contract for the production and/or redesign of the website by the client to ITLover is considered as a guarantee that all such permissions and authorizations have been obtained. ITLover reserves the right to request proof of permissions and authorizations if necessary.
The customer is solely responsible for making a proper backup copy of the site before authorizing ITLover to take the necessary actions to perform the contract. ITLover is not responsible for the loss or damage of existing data when working without access to hosting.
ITLover does not take responsibility for any damage, interruption, change, deletion of data caused by the client or third parties after it is transferred to the client’s pages/site. Such cases include but are not limited to the removal/deconfiguration of plugins, mods.
ITLover accepts payments via PayPal or credit card. If the user cancels the service before completion, the fee will be equal to the amount of work performed at the time of cancellation.
The project includes various stages, and the work of the next stage will start only after receiving the appropriate payment for the previous stage as per the agreement. After the service is completed, the website will be uploaded to the server’s user area for approval. Once approved by the client, the website is uploaded to the destination server where the site is to remain. ITLover reserves the right to delay uploading the website until full payment is received. All developed code and materials will be handed over to the client after the project is completed and signed off. Ownership of the code will remain with the client after final payments.
After the site is launched, we offer free support for the first month. After one month of free service, upon agreement, a paid package will be extended that best suits the client’s requirements. We also offer discounts if the customer chooses a higher-priced package. The free support period covers only bug fixes and support for the customer to manage the multimedia elements/content independently, and excludes any issues related to site architecture, policy changes, plugins/configurations.
Any third-party support, products, and/or services used/integrated into the Site that require licensing, payment, copyrights, etc., are the sole responsibility of the Customer and shall be provided by the Customer or purchased by ITLover on behalf of the Customer upon payment in advance of the cost of such purchase.
ITLover makes no guarantees as to the accuracy or performance of any third-party product/service. We rely on personal experience with the performance of various third-party services/add-ons and can only provide a recommendation.
Any upgrade/reconfiguration of a third-party product/service used in a project should not be part of ITLover’s scope. This should be considered on a case-by-case basis, and price and time revisions may be requested by ITLover.
Any additional functionality not covered by the project scope will be reviewed through the change management process, and the appropriate work cost will be added.
Most corrections, such as minor changes/fixes, usually do not go beyond the original project plan. If we observe any abuse of this, we will maintain a list of the work added during the development of the site and determine the appropriate time/additional cost of work performed.
While we do our best to cover most changes within the site budget, some changes are classified as system enhancements/additions and incur a charge. We will consult you before we start working on any such changes.
Any rework, change, or revision request by the client after post-approval and/or project process will be treated as additional work and will be billed in addition to the agreed timescales.
ITLover cannot provide service guarantees on behalf of third-party organizations and shall not be liable for the failure of any service provided by third parties. Our liability is limited to the service we provide and not to the interruptions and errors of third-party plugins/services.
We will not be liable for any loss or damage related to your use of our Services. If the customer is dissatisfied with our website or services, they can stop using our website/services at any time. These terms are an agreement between the customer and ITLover. By accepting them, the customer agrees to our terms and conditions.
For medium (2 weeks or less) and smaller projects, the client only pays for the domain, hosting, and other paid services/add-ons of their choice in advance, and the cost of our services is covered after the project is completed.
In the case of longer-term (more than 2 weeks) projects, if the project includes different stages, work on the next stage will begin only after the work of the previous stage and the payment for the corresponding work have been received.
After the completion of the service (website design and/or website creation), the website is uploaded to the client area of the ITLover server (webcraft.ge ITLover Lab) for approval. Once approved by the client, the website is uploaded to the destination server where the site will remain. ITLover reserves the right to delay uploading the website until full payment is received.
All the developed code and materials will be handed over to the customer after the completion and delivery of the project. Ownership of the code will remain with the client after final payments.
ITLover has the right to publish and use the completed work and/or the final product/website as a presentation to other potential customers. In cases where it is necessary to limit the aforementioned, the client must notify ITLover in advance and request prior consent.
ITLover aims to perform all services within the agreed time frame. The terms will commence upon receipt of both the agreed deposit and all website content.
ITLover may require an extension of time due to circumstances beyond its control.
We reserve the right to add, change, or remove any part of these Terms at any time, with or without prior notice to you. It is recommended that you read these terms from time to time. Your continued use of our website or services means that you agree to the new updated terms. We will archive older versions of the Terms and Conditions, and they can be accessed via the links at the bottom of this page.
